Terms and Conditions — Version 1.0

The version of these terms in force at the date of your quote applies to that quote.

Your quote

Your quote sets out the scope, the price and the payment stages for your project. These terms apply to it. Please read them before accepting.

Payment

Payment stages are as set out on your quote.

Where your project is home building work, the deposit is capped at 6.5% of the contract value under the Home Building Contracts Act 1991 (WA). Supply-only orders, where we sell you a kit and do not install it, fall outside that Act.

Goods are not released or installed until each stage is paid.

All debt-collection costs incurred through non-payment are payable by the customer.

If a customer defaults on payment, all outstanding amounts become immediately payable.

Made-to-measure orders

Orders are made to measure. Cancellations are not refundable once manufacturing has commenced.

Price changes

Manufacturer price increases occurring after order placement may be passed on to the customer.

Ownership

Ownership of all materials remains with Dynaspan until the invoice is paid in full. If payment is not made, Dynaspan may recover the goods from site.

Delivery

Delivery times are approximate and may vary with weather or council processing.

The customer must provide adequate access. Any cranes, forklifts or mechanical assistance required for unloading is at the customer’s cost.

Please check your delivery on arrival and tell us in writing within 48 hours if anything is damaged or missing, so we can put it right quickly. This does not affect your rights under the Australian Consumer Law.

Council and approvals

The customer authorises Dynaspan to act on their behalf for council documentation.

Any additional requirements, conditions or changes imposed by the Shire or Council are payable by the customer.

If council approval is refused before manufacturing has commenced, the order is cancelled and only the deposit is retained. If you have asked us to begin manufacture before approval is granted, any costs already incurred are payable, and the deposit together with those costs is retained.

Site conditions and erection

Pricing is based on standard conditions. Extra costs apply for rock, reactive soil, poor access, underground obstructions or unprepared sites.

The customer must provide a clear, level pad. Additional charges apply if the pad is not level.

Downpipes are supplied to ground level only. Stormwater connection is not included.

Delays caused by site access, weather or incomplete preparation may incur rescheduling and additional charges.

Concrete, where applicable

Pricing assumes easy access and a level, prepared site.

Pumps are not included unless stated otherwise.

If difficult digging conditions are encountered, or pier depths exceed 400mm, auger or digging equipment may be required at the customer’s expense.

Variations and engineering

Engineering variations or council-required changes after quoting are chargeable. All variations will appear on the final invoice.

Builder registration

Building work valued over $20,000 must be carried out under a registered builder. If you ask Dynaspan to arrange this, a fee of 15% of the contract value applies and will be shown as a separate line on your quote.

Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or removes those rights.

Where the law permits us to limit our liability, it is limited to repairing or replacing the goods, or resupplying the services, at our option.

General

Minor measurement variations do not constitute defects.

The customer acknowledges they have undertaken their own due diligence regarding suitability and council requirements.
